Injured At Work: Now What?
If you have an on-the-job injury here is what you can expect to happen. First, you file a Claim Form with the employer. If immediate treatment is needed you go to the to the employer-designated doctor or other medical treatment facility in the case of emergency. You never pay anything for the medical treatment no matter how expensive it is if the insurance company accepts the claim. If the doctor takes you off work you will receive two-thirds of your average weekly wage/salary.
The insurance company might take your deposition. There, the insurance company attorney will ask questions about your medical history and other personal matters. If there is a delay in receiving the two-thirds payment you will apply for State Disability.
Eventually the doctor will decide that your injury has been healed as much as possible. If your recovery is not 100% you will receive payment for the resulting "permanent disability." Of course, there are many details to the process.
If you retain an attorney you never pay any attorney fee until the end of the case. The judge usually allows 12% attorney fee based on the value of your case.
