The Black Lung Benefits Act and ERISA

Workers in the coal industry who are totally disabled by the Black Lung disease or pneumoconiosis can claim benefits under the Black Lung Benefits Act. This is a Federal Law just like the ERISA. Both are administered by the Federal Government and are meant to protect workers.

Black Lung Benefits Act

The BLBA ensures that coal industry workers totally disabled by the black lung disease because of employment in the coal mines or related industries are given monthly payments and medical benefits to cover their health-related expenses. Only medical expenses directly related to the black lung disease are reimbursable under this Act. This Act also provides monthly payments to the dependents of a worker whose death was caused prematurely because of the black lung disease. Here dependants include not just the spouse and under age children, but also dependent parents as well as siblings. However, it is important to prove that the deceased worker was supporting the claimant for the claim to be approved. Claimants should notify the authorities of any change in circumstances that could impinge on their right to claim benefits. If a worker recovers and rejoins the workforce, then also the authorities and the employer need to be notified of the change in circumstances.

Additionally, social security benefits are reduced by the amount received as Black Lung compensation.

ERISA

ERISA is a Federal Law that states that employers who set up a retirement benefits and health insurance plan must ensure that their plan meets certain minimum requirements. There is, however, no compulsion on employers to set up a retirement benefits plan. It essentially sets minimum standards for pension plans set up by employers. ERISA supervises pension plans once they are set up. It also ensures that health insurance schemes are properly administered. ERISA ensures that the retirement fund is not mismanaged and that the details of the fund are reported periodically and automatically to those who have an interest in such funds.

While ERISA is funded by both employees and employers to ensure financial security in the retirement age, the Black Lung Act ensures that coal industry employers pay a special charge to a black lung fund to ensure that coal workers are compensated for the disability they incur from working with coal. In case the employer is identifiable, that particular employer and their insurance company are liable to pay for the benefits and medical expenses. Also, only those workers who are completely disabled because of the black lung disease are eligible for benefits under the Black Lung Act. ERISA, on the other hand, provides cover to all workers.
