New York Workers' Compensation State law provides that no benefits coverage may be awarded to the employee when injury is occasioned solely by the employee's intoxication from alcohol or a controlled substance. There is a statutory presumption that the injury did not result solely from intoxication. N.Y. Workers' Compensation Law §10 (1992).
