Who provides workers compensation in Massachusetts?

Workers Compensation in Massachusetts is provided by employers. All employers must purchase workers compensation for employees with a few limited exceptions, such as agricultural employers. As such, if you are injured in a work related injury, you will collect compensation for medical bills and lost wages, as well as your disability payments if appropriate, from the insurance your employer has purchased for you. If you have problems or issues with collecting the benefits you believe you are due, the Department of Industrial Accidents is the administrative agency that would assist you. 

The workers compensation process is designed to provide employees with a great deal of protection. Any injury or illness that arises as a direct result of your job or work duties is going to be covered, even if your employer was not negligent. This is true even if the injury did not occur at your usual office or job site, as long as you can prove that the injury happened directly because of your job.  It is also true even if you were negligent, as long as you weren't drunk or high or expressly violating the rules of your company. 

Provided you are eligible, you may file a claim with your employer's workers compensation provider and should begin receiving benefits. If there are issues, then you may appeal internally first to the insurer providing the coverage. If this appeal fails, then you can file further appeals with the Department of Industrial Accidents. Only after you have exhausted the administrative appeals process will you be able to file an appeal in court.
