In spite of increased safety awareness and on-the-job precautions, many employees sustain injuries or illnesses in the course of carrying out their job-related duties. If you have been injured in the workplace, it is important to file a workman's' comp claim as soon as possible in order to gain access to full eligibility for medical and financial benefits. Although most employers are required by law to provide injured workers with the necessary claim forms and other paperwork, some employers may attempt to dissuade their employees from filing a claim, or may otherwise downplay the seriousness of the situation. Although these types of inducements are supposedly designed to promote workplace safety, some courts have ruled that they may present an unfair barrier to injured workers who are seeking their rightful compensation benefits under the law.
