Workers Compensation Appeals Board

In all fifty states, workers who are injured on the job may be entitled to a number of benefits if the details of their case conform to all applicable criteria. After an on-the-job injury or illness occurs, employees should notify their supervisor or manager as soon as possible. In most jurisdictions, the employer is required to provide the injured worker with an accident report form within one or two working days of the incident that caused the injury. After this documentation is filled out and completed, the claim will be submitted to the employer's insurance carrier for review. If the insurer opts to deny the claim, the injured worker then has the right to request a hearing in front of the state's workers' compensation appeals board. At this hearing, the injured worker will have the opportunity to present evidence in his or her own defense. In some states, the injured employee can request an additional hearing if their original request is denied.
