A work injury lawyer is a lawyer who works on behalf of employees whose injuries have resulted from their work. Depending on the case, a work injury lawyer may have several possible courses of action to pursue. First, they may attempt to help the injured employee seek worker's compensation. Workers compensation, or workers' comp, takes advantage of the employer's insurance policy and is no-fault, meaning a company is liable under workers' comp regardless of fault. If fault is in question, then a there may be a choice between worker's comp and a negligence lawsuit; however, accepting a workers' comp claim waives the employee's right to file a lawsuit later. There is, however, a last option known as FECA – the federal Employees Compensation Act. This is a federal benefits package for disabilities or death resulting out of employment.
